Information of public interest

A request for access to information of public interest shall be submitted to the Tax Administration of the Republic of Serbia, in accordance with Article 15 of the Law on Free Access to Information of Public Interest, in writing.

The request must contain: the name and address of the Tax Administration, information about the person requesting the information (name, surname, address, telephone number or other contact information), a description of the information requested as precisely as possible (clearly stating the information requested, i.e. what it specifically refers to) and the method of submitting the information. The request may, but does not have to, contain reasons as well as other information that facilitates finding the requested information.

Request for access to information of public interest

The authorized person for acting upon requests for free access to information of public interest on behalf of the Tax Administration is Miroslav Erić., e-mail: ijz@purs.gov.rs.

In accordance with Article 16 of the Law on Free Access to Information of Public Interest, the Tax Administration is obliged to notify the information seeker without delay, and no later than within 15 days from the date of receipt of the request, of the possession of the information, provide him with a document containing the requested information, or issue or send him a copy of that document.

If the Tax Administration, for justified reasons,  is unable to act on the request within 15 days from the date of receipt of the request, it is obliged to immediately notify the requester and set a subsequent deadline, which cannot be longer than 40 days from the date of receipt of the request, within which it will inform the applcant about the possession of the information, provide him with the document containing the requested information, issue him or send him a copy of that document.

If the Tax Administration does not respond to the request within the deadline, the applicant may file a complaint with the Commissioner in accordance with Article 22 of the Law on Free Access to Information of Public Interest.

The Tax Administration shall, together with the notification that it will provide the applicant with the document containing the requested information, or issue him a copy of that document, inform the applicant of the time, place and manner in which the information will be provided to him, the amount of the necessary costs of making a copy of the document, and in the event that it does not have the technical means to make a copy, it shall inform the applicant of the possibility of making a copy using its own equipment.

The document containing the requested information can be inspected at the official premises of the Tax Administration.

In accordance with Article 17 of the Law on Free Access to Information of Public Interest, inspection of the document containing the requested information is free of charge.

The applicant may, for justified reasons, request to inspect the document containing the requested information at a time other than the time specified by the Tax Administration.

A person who is unable to inspect the document containing the requested information without an escort will be allowed to do so with the assistance of an escort.

If the request is granted, the Tax Administration will not issue a special decision, but will make an official note to that effect.

If the Tax Administration refuses to fully or partially inform the applicant about the possession of information, to provide him with a document containing the requested information, to issue or send him a copy of that document, it is obliged to issue a decision rejecting the request and to explain that decision in writing, as well as to refer the applicant in the decision to the legal remedies that he may declare against such a decision.

The applicant may file an appeal with the Commissioner within 15 days of the delivery of the Tax Administration's decision, in accordance with Article 22 of the Law on Free Access to Information of Public Interest.
